Terms of Service

These Terms of Service ("Terms") govern your access to and use of Talktempus (the "Service"), operated by Evolve and Advance Consulting LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Ownership

The Service, including its source code, design, branding, and all related intellectual property, is owned by Evolve and Advance Consulting LLC and is protected by copyright and other intellectual property laws. These Terms do not grant you any ownership rights in the Service.

2. Acceptable use

You agree not to:

Copy, modify, or create derivative works of the Service or any part of its source code, beyond your own use of the app as intended.
Reverse-engineer, decompile, or attempt to extract the source code of the Service beyond what is inherently visible through normal browser use.
Scrape, crawl, or systematically extract data from the Service.
Use the Service to build a competing product.
Redistribute, resell, sublicense, or provide access to the Service to third parties without our written permission.
Use the Service for any unlawful purpose or in a way that interferes with its operation for other users.

3. Your manuscripts and talks

Talktempus is built so that your manuscript, script, or notes are processed and stored entirely on your own device. We do not receive, transmit, or store the text of anything you write or paste into the app. There is nothing on our servers to license back to you, because it never reaches us.

What we do store, tied to your account if you create one: your email address, your subscription status and trial dates, and numeric session data (how long a talk ran, how it was paced, how many sections it had), never the words themselves. See our Privacy Policy for the complete list.

If you choose to share a session report generated by the app, that sharing is your own action, using your device's own share or copy features. We are not a party to who you send it to.

4. Accounts and subscriptions

Some features require creating an account (an email address, verified by a one-time code) and some require an active paid subscription. Subscription billing is handled by Stripe; by subscribing, you also agree to Stripe's own terms for processing that payment. You may cancel a subscription at any time; you will retain access through the end of the period already paid for.

5. No warranty

The Service is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. In particular, we make no guarantee that the Service will be available, error-free, or accessible offline in every circumstance, though it is designed to work offline once loaded.

6. Limitation of liability

To the maximum extent permitted by law, Evolve and Advance Consulting LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service — including, without limitation, any consequence of a talk, sermon, or presentation not going as planned.

7. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. If we do so for a reason unrelated to a violation of these Terms, we will make reasonable efforts to let you export or retrieve your account data first.

8. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

9. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.
